These Terms apply solely to your use of Fiskil's services as a customer, including where you act as a representative of Fiskil under the Consumer Data Right (CDR).

By clicking "I agree," "Continue," or a similar checkbox or button or accessing or using the services, you indicate your assent to be bound by these Terms. If you do not agree to these Terms, do not use or access the services.

1. Access Rights and Restrictions

1.1 Access: Subject to your compliance with these Terms, Fiskil grants you a non-exclusive, non-transferable, and revocable right to access and use Fiskil's services for the intended purposes.

1.2 Restrictions: Unless explicitly permitted by Fiskil in writing, you must not:

Attempt to reverse engineer, decompile, disassemble, or otherwise discover the source code or algorithms of the services.
Modify, translate, or create derivative works based on the services.
Use the services for any unlawful or unauthorized purpose.
Sell, resell, license, sublicense, or distribute the services or data derived from the services to any third party.
Publicly disseminate performance information about the services without prior written approval from Fiskil.
Use the services in any manner that could be deemed a "consumer report" under the Fair Credit Reporting Act (FCRA) or similar regulation.

1.3 Ownership: Fiskil retains all rights, title, and interest in and to the services, including but not limited to its software, products, and intellectual property. Any feedback provided by you regarding the services shall be the property of Fiskil.

2. Data Usage and Privacy

2.1 Your Data: You represent and warrant that any data you provide to Fiskil is accurate, lawful, and that you have the necessary rights to share it.

2.2 Processing of Data: Fiskil may process, store, and use your data in accordance with its Consumer Data Right Policy and applicable privacy laws.

2.3 Prohibited Use of Data: You must not use any data obtained through Fiskil's services for any purpose that violates applicable law or regulations.

3. Fees and Payments

3.1 Fees: Certain features of Fiskil's services may be subject to fees, which will be disclosed before use.

3.2 Payment Terms: You agree to pay all applicable fees as per Fiskil's pricing plan. Fees are non-refundable except as required by law.

3.3 Changes to Fees: Fiskil reserves the right to update pricing with reasonable prior notice.

4. Termination

4.1 By You: You may terminate your account at any time by contacting Fiskil support at support@fiskil.com.au.

4.2 By Fiskil: Fiskil may suspend or terminate your access if you violate these Terms or if continued service would create risk for Fiskil or its customers.

4.3 Effect of Termination: Upon termination, your access to the services will be revoked, and any outstanding obligations must be settled.

5. Liability and Disclaimers

5.1 Disclaimer: The services are provided "as is" without warranties of any kind. Fiskil makes no representations about the accuracy, reliability, or completeness of any data provided.

5.2 Limitation of Liability: To the maximum extent permitted by law, Fiskil shall not be liable for indirect, incidental, or consequential damages. Fiskil's total liability is limited to the amount you have paid for the services in the last six months.

6. Modifications to Terms

6.1 Fiskil may update these Terms from time to time. We will notify you of material changes via email or our platform. Continued use of the services constitutes acceptance of the updated Terms.
